About Analysis 1

1.1 These Terms and Conditions of Business govern the relationship which will exist between us. When you place an order on our website you will be asked to agree to these terms in their entirety. Unless otherwise agreed, these Terms and Conditions of Business shall apply to any future instructions given by you to Analysis 1. Nobody is authorized to alter these terms other than in writing. Please read the terms carefully before you place an order

1.3 Analysis 1 is a privately owned entity based in the United Kingdom and operating from Tower Court, Oakdale Road Clifton Moor York North Yorkshire Y030 4XL United Kingdom

Analysis 1 specialise in selling COVID-19 tests to customers across the UK through our partner laboratory Source Bio Science (1 Orchard Place Nottingham Business Park Nottingham, NG86PX United Kingdom) as our affiliated laboratories

1.4 Our terms explain who we are and how we provide our services to you. If you have any queries about these terms, our services, a booking or order you have made please contact us at help@analysis1.co.uk

1.5 We offer the following PCR Testing services:

Mandatory Day 2 and Day 8 International Arrival PCR Tests. These can be booked online on our website.

  1. Placing An Order And Booking An Appointment On Our Website

2.1 You are required to provide some personal information to enable you to place an order via our website.

2.2 The booking pages on our website guide you through the steps you need to take to place an order for the COVID-19 tests we sell.

  • Before you are required to pay you will have the opportunity to review your booking and make any amendments
  • Once you have purchased your test you will receive an email confirming your purchase and advising you of the next steps
  • The contract between you and Analysis 1 is only formed once we have received payment and confirmed this to you by email
  1. Price And Payment

3.1 All prices are shown on our website and include VAT

3.3 All payments must be made by credit or debit card. A third-party service is used to process your payment securely. No payment information is collected by Analysis 1 as you are redirected to a third party’s payment gateway and then redirected back to our website

  1. Your Responsibilities

4.1 You should only provide information to us where you are entitled to do so. Where you provide information to us for the purpose of our provision of the Services to you (or a child for whom you are a parent or guardian), you confirm that you are entitled to provide us with that information for that purpose. If you provide us with information against the law (such as data protection law, confidentiality obligations or intellectual property law), and a third party brings a legal claim against us as a result of your unlawful actions, you will be fully responsible for the costs and losses that we incur

4.2 Make sure your information is correct. We will use the information you provide to us to supply the service to you. We will not be responsible for supplying the service late, not supplying any part of it, inaccuracy, or inconclusiveness in results of the service if this is caused by you not giving us the information we need. You confirm that all information and details provided by you to us on our website and to our partners are true, accurate and up to date. You can update or correct your details at any time by sending an email to help@analysis1.co.uk

4.3 You should follow our instructions when receiving our service. You should follow any instructions that you are given by other health professionals.

4.4 The service we provide only includes the sale of COVID-19 testing kits and, in the case of a positive test result, you are advised to follow government guidelines. If you require any healthcare treatment, you should visit your GP or seek urgent medical attention, by either dialling 111 or 999

4.5 You may order and book our services for yourself and a child that you a parent or guardian for. If you book our services for anyone over the age of 18 it will be their responsibility to provide all the correct information as described in 2.2

  1. Delivery Of The Services

5.1 Whilst we will aim to deliver the results of your test in the timescale agreed when purchasing the service, this cannot be guaranteed should there be an interruption in transferring your swabs to our laboratory. You will be notified by email and text when you results are available. You will be required to obtain your results from your account

5.2 We may have to suspend the supply of services to you to deal with technical problems or make minor technical changes or updates to the service to reflect any statutory or regulatory changes. We will inform you in advance when we will be suspending the service unless the issue is an emergency or urgent. If this affects you, we will review the price or issue a refund, so you do not pay for the service if it is suspended. You may be able to rearrange the service or end the contract

  1. Provision Of Our Testing Kits

6.1 Our testing services are provided by qualified, registered health professionals. If you have any doubts regarding our services, please contact us as soon as possible by emailing help@analysis1.co.uk

6.2 Analysis 1 will not be liable for any loss or damage (including refunds) suffered by you due to:

6.3.1 Incorrect information submitted to us;

6.3.2 Incorrect use of the kits and / or failure to follow instructions provided with the kits or on our website;

6.3.3 Failure to activate the kit on the laboratory portal (where applicable);

6.3.4 Failure to enter a correct email address (where applicable);

6.3.5 Failure to follow instructions to post the test kit to the laboratory;

6,3.6 Posting the kit without activating the kit as directed in the instructions (if applicable);

6.3.7 Posting the kit without taking the test;

6.3.8 Failures or delays by third parties used in connection with the provision of our PCR testing service such as the postal system, couriers and our partner laboratories;

 

6.3.9 Reliance on any guidance on travel regulations by us. It is your responsibility to comply with the current travel regulation in force

  1. Refunds & Returns Policy

We operate a strict no refund and returns policy with no exceptions

7.1 If the test booking reference number (ANALY Number) has been generated by us and sent to you we cannot provide a refund

7.2 The COVID testing kits cannot be returned to us once received by you. This is due to risk of transmission of the virus

7.3 We cannot provide a refund for leakage from the sample collection bottle or missing swab. In these circumstances a replacement item will be dispatched on request

7.4 We cannot provide a refund for delays in receipt of the testing kits or results from the laboratory as a result of factors outside of our control such as delays in the postal system or delays in processing the kits by the laboratory

7.5 We cannot provide a refund as a result of one or more of the failures at paragraph 4 above

7.6 You cannot terminate the contract, in accordance with paragraph 8, between us if 7.1 has occurred

  1. Termination Of Contract

8.1 Where the contract is not terminated it will expire once we have provided the service to you

8.2 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired

Please note the termination of contract provisions are not applicable if the service has already been provided in accordance with paragraphs 5 – 7 above

8.3 We will refund you the price you paid for the services as soon as possible provided you have informed us within 14 days of ordering or paying for the service.

8.4 Notice of termination will be effective from the date and time of receipt

8.5 Please note termination of the contract between us is subject to paragraph 7 above

9.1 Where we do not carry out the Services with reasonable care or skill, you can ask us to repeat the service

  1. How To Make A Complaint

11.1 If you wish to make a complaint about an order or anything else, you can contact us at help@analysis1.co.uk

11.2 We will handle your complaint in an appropriate and professional way.

11.3 We will discuss your complaint with you and let you know the outcome of our investigation. Where there is a disagreement between you and us about these terms, or you raise a complaint about our services, we will attempt to resolve this by discussing it with you. We will tell you the outcome of our investigation into your complaint and give you the chance to discuss it with us. If we have done something wrong, we will apologise to you

  1. Our Responsibility For Loss Or Damage Suffered By You

12.1 We are responsible to you for foreseeable loss and damage caused by us. Unless the law requires otherwise, we will not be liable to you for any amount higher than the amount that you (or if you are under 18 your guardian) actually paid us for the services giving rise to the liability. If we fail to comply with these terms, we are responsible only for foreseeable loss or damage that you suffer as a result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any other loss or damage. Loss or damage is foreseeable only if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew that it might happen. We will not be liable for any loss or damage caused by you not following the instructions for using our services or breaching any agreement you have with us

12.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the services

12.3  We are not liable for business losses. We only supply the services for domestic and private use. If you use the services for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity

12.4 Third parties. We will not be liable for any loss or damage suffered by you, any third party or any property arising out of or in connection with the acts or omissions of any third party, including in circumstances where you were referred to such third party by us or where such third party was recommended to you by us

12.5 Our Services should not be used in an emergency. In the case of an emergency, you should contact the emergency services and/or your GP in the usual way

  1. Other Important Terms

13.1 Our partner laboratories assist us by carrying out the laboratory work needed to provide you with a test result. All our partner laboratories are UKAS accredited  to provide fit to travel and test to release laboratory services

13.2 This contract is between you and us. No other person shall have any rights to enforce any of its terms. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing

13.3 If a court finds part of these terms illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect

13.4 Even if we delay enforcing these terms, they can still be enforced later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking the contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you later

13.5 These terms are governed by English law and you can bring legal proceedings in respect of the Services in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the Services in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the Services in either the Northern Irish or the English courts

13.6 We are committed to promoting equality and diversity in all of our dealings with clients, third parties and employees

13.7 We use the information you provide primarily for the provision of covid testing to you and legal and regulatory compliance. Our use of that information is subject to your instructions, the Data Protection Act 1998, General Data Protection Regulation and our duty of confidentiality. You have a right of access under data protection legislation to the personal data that we hold about you
